1. Introduction

Welcome to ARQAM OTP. These Terms and Conditions govern your use of our WhatsApp Business API verification services operated by ARQAM OTP. By accessing or using our services, you agree to be bound by these terms. If you do not agree with any part of these terms, you may not use our services.

2. Service Description

ARQAM OTP provides OTP (One-Time Password) verification services through the official WhatsApp Business API. Our services include:

  • WhatsApp OTP message delivery using Meta-approved templates
  • API access for integration with your applications
  • Dashboard for monitoring message delivery and usage
  • WhatsApp campaign messaging services

3. Account Registration

To use our services, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Be at least 18 years old or the legal age in your jurisdiction
  • Have the authority to bind your organization to these terms if registering on behalf of a company

4. Payment Terms

Our service operates on a prepaid credit system:

  • Credits must be purchased in advance before sending messages
  • 1 credit = 1 delivered message
  • Credits are deducted only for successfully delivered messages
  • Credits never expire and remain in your account until used
  • All purchases are final and non-refundable (see our Refund Policy)
  • Prices are displayed in Iraqi Dinar (IQD) and are subject to change

5. Acceptable Use Policy

You agree NOT to use our services for:

  • Sending spam, unsolicited messages, or bulk marketing without consent
  • Fraudulent activities, phishing, or identity theft
  • Harassment, threats, or abusive communications
  • Distribution of malware, viruses, or harmful content
  • Any illegal activities or violation of local laws
  • Circumventing WhatsApp's policies or terms of service
  • Sending messages to numbers without proper user consent

Violation of this policy may result in immediate account suspension or termination without refund of remaining credits.

6. API Usage

When using our API, you agree to:

  • Keep your API keys confidential and secure
  • Not share API credentials with unauthorized parties
  • Implement proper rate limiting in your applications
  • Not attempt to reverse engineer or exploit our systems
  • Report any security vulnerabilities you discover

7. Service Availability

We strive to maintain 99.9% uptime for our services. However, we do not guarantee uninterrupted access and are not liable for any downtime, delays, or delivery failures caused by third-party services (including WhatsApp/Meta), network issues, or circumstances beyond our control.

8. Intellectual Property

All content, trademarks, logos, and intellectual property related to ARQAM OTP are owned by us or our licensors. You may not use, copy, or distribute our intellectual property without written permission. Your use of the service does not grant you any ownership rights to our platform or technology.

9. Limitation of Liability

To the maximum extent permitted by law, ARQAM OTP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of our services. Our total liability shall not exceed the amount you paid for credits in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ARQAM OTP, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.

11. Account Termination

We may suspend or terminate your account if you:

  • Violate these terms or our acceptable use policy
  • Engage in fraudulent or illegal activities
  • Fail to pay for purchased credits
  • Abuse our services or infrastructure

Upon termination, any remaining credits in your account will be forfeited.

12. Modifications to Terms

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of the service after changes constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of Iraq. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts in Iraq.
